Right of Withdrawal (Widerrufsrecht)

1. Exceptions for Perishable Groceries

Pursuant to §312g Abs. 2 Nr. 2 BGB, the statutory right of withdrawal does not apply to contracts for the supply of goods that can deteriorate quickly or whose expiry date would quickly be passed. This includes the majority of food products offered on the SouqGo marketplace, in particular:

• Fresh fruit and vegetables
• Fresh meat, poultry, and fish
• Fresh dairy products, eggs, and chilled items
• Fresh bakery products
• Any other items bearing a short best-before or use-by date

For these categories no right of withdrawal exists. Instead, the legal warranty rights under §§437 ff. BGB apply in full: if goods are defective or not as described at the time of delivery, please contact us immediately.

2. Right of Withdrawal for Non-Perishable Goods

For non-perishable goods (e.g. packaged spices, canned goods, beverages in sealed packaging, household items) that are sold on the platform and are not subject to the exceptions in §312g Abs. 2 BGB, you have the following right of withdrawal:

3. Consequences of Withdrawal

If you withdraw from this contract we will reimburse all payments we have received from you, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the date on which we receive your withdrawal notification.

Reimbursement will be made using the same payment method you used for the original transaction unless we expressly agree otherwise. Under no circumstances will you be charged fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence of having sent back the goods, whichever is the earliest. You must send back or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal.

You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to ascertain the nature, characteristics and functioning of the goods.

5. Summary of Exceptions (§312g Abs. 2 BGB)

The right of withdrawal is excluded for all of the following categories where applicable:

• Goods that are liable to deteriorate or expire rapidly (§312g Abs. 2 Nr. 2)
• Sealed goods that are not suitable for return for health-protection or hygiene reasons and that were unsealed after delivery (§312g Abs. 2 Nr. 3)
• Goods that, after delivery, according to their nature become inseparably mixed with other goods (§312g Abs. 2 Nr. 4)
